Continuando con el artículo publicado el 9 de abril de 2015 (al que se puede acceder a través del enlace en la versión inglesa de este boletín y del que adjuntamos la traducción correspondiente) la Asociación quiere recordar a sus Miembros que la Normativa de Control para la Contaminación del Aire (buques oceánicos [Ocean Going Vessels – OGV]) – la Normativa – entrará en vigor el 1 de julio de 2015.

Todos los buques oceánicos (OGV) que atraquen en Hong Kong deberán utilizar combustible homologado durante el período de prohibición.

El combustible homologado se define como:

a) Combustible marino con bajo contenido en azufre (con un contenido de azufre que no exceda 0,5% por peso);
b) Gas natural licuado; o
c) Cualquier combustible que la Autoridad pueda autorizar que efectivamente reduzca las emisiones de dióxido de azufre a un nivel por lo menos tan bajo como el combustible marino con bajo contenido en azufre.

El período de prohibición se define como el período de atraque de los buques excluyendo:

a) La primera hora del período de atraque; y
b) La última hora del período de atraque.

Cualquier OGV que utilice combustible no homologado durante el período de prohibición estará cometiendo una infracción bajo la Normativa. El capitán y el armador pueden ser procesados y, en caso de ser condenados, se les podría imponer una multa máxima de $50,000 y una pena de cárcel de tres meses.

Further to our article published on 09 April 2015, the Association would like to remind its Members that the Air Pollution Control (Ocean Going Vessels) (Fuel at Berth) Regulation (the “Regulation”) is coming into force on 1st July 2015.

All ocean going vessels (OGV), berthing at Hong Kong shall use compliant fuel during the prohibition period.

Compliant fuel is defined as:

a) Low sulphur marine fuel (with sulphur content not exceeding 0.5% by weight);
b) Liquefied natural gas; or
c) Any fuel that the Authority may approve as effectively reducing the emissions of sulphur dioxide to a level at least as low as the low sulphur marine fuel.

Prohibition period is defined as the berthing period of the vessel excluding:

a) The first hour of the berthing period; and
b) The last hour of the berthing period.

Any OGV using non-compliant fuel during the prohibition period will be committing an offence under the Regulation. The master and owner concerned may be prosecuted and, if convicted, would be liable to a maximum fine of $200,000 and imprisonment for six months.

Record keeping and preservation of documents such as bunker delivery notes and log books also form part of the obligations under the new Regulations. Failure to comply with these requirements may lead to a maximum fine of $50,000 and imprisonment for three months.
